1. Introduction & Acceptance of these Terms
Welcome to Ziko AI.
These Terms of Service ("Terms") govern your access to and use of the Ziko AI mobile application, SAPYENS website, and any related services (collectively, the "Services").
The Services are legally provided by Fabio Habchi, operating under the commercial brand SAPYENS ("SAPYENS," "we," "us," or "our").
By creating an account, accessing, or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree with these Terms, you must not use the Services.
If you are under the age of 18, you confirm that you have permission from a parent or legal guardian to use the Services. In all cases, you must be at least 13 years old to create an account or use Ziko AI.
These Terms form a legally binding agreement between you and SAPYENS regarding your use of the Services.
We believe technology should empower people to build healthier habits with confidence. While we strive to provide a reliable, secure, and high-quality experience, your use of the Services also carries certain responsibilities, which are explained throughout these Terms.
2. Eligibility & User Accounts
To use Ziko AI, you must be at least 13 years of age. If you are under the age of 18, you represent that you have obtained permission from a parent or legal guardian to use the Services.
When creating an account, you agree to provide accurate, complete, and up-to-date information. You are responsible for keeping your account information current and for maintaining the confidentiality of your login credentials.
You are responsible for all activities that occur under your account. If you believe your account has been accessed without your authorization or that your account security has been compromised, you should notify SAPYENS support as soon as reasonably possible.
Each account is intended for use by a single individual. You may not share, sell, transfer, or allow others to use your account without our prior written permission.
You may delete your account at any time using the options available within the Services. Account deletion is subject to our Privacy Policy and any legal obligations requiring us to retain certain information for a limited period.
To help maintain a safe, reliable, and fair experience for all users, SAPYENS may temporarily suspend or permanently terminate access to the Services if we reasonably believe that you have violated these Terms, engaged in fraudulent or unlawful activity, attempted to compromise the security or operation of the Services, or otherwise used the Services in a manner that could harm SAPYENS, other users, or third parties.
Where appropriate, we may provide a warning or an opportunity to correct a violation before taking action. However, we reserve the right to suspend or terminate accounts immediately when necessary to protect the security, integrity, or lawful operation of the Services.
3. Description of the Services
Ziko AI is an AI-powered health and fitness platform designed to help users build healthier habits through personalized guidance, educational insights, and intelligent tools.
Depending on your subscription and the features available at the time, the Services may include personalized nutrition recommendations, calorie and macronutrient tracking, workout planning, progress monitoring, AI-powered conversations, educational content, and other health and wellness features.
Our goal is to provide a helpful, motivating, and personalized experience. As we continue to improve Ziko AI, new features may be introduced, existing features may evolve, and some features may be modified or discontinued over time. These updates help us enhance the quality, security, and reliability of the Services.
While we strive to provide accurate, useful, and high-quality recommendations, Ziko AI is intended to support—not replace—your own judgment and decision-making. Individual results vary based on many factors, including consistency, lifestyle, personal circumstances, and health conditions. For this reason, SAPYENS cannot guarantee specific outcomes, including weight loss, muscle gain, improvements in fitness, nutritional results, or other personal goals.

4. AI Features & Important Health Information
Artificial intelligence is at the heart of Ziko AI. Our AI-powered features are designed to provide personalized guidance, educational insights, and practical recommendations to support your health and fitness journey.
Although we continuously work to improve the quality and accuracy of our AI systems, no artificial intelligence system is perfect. Responses and recommendations may occasionally be incomplete, inaccurate, or based on information that is outdated or misunderstood. For this reason, you should use your own judgment when making decisions based on AI-generated content.
The information and recommendations provided through Ziko AI are intended for general informational and educational purposes only. They are not medical advice and should not be considered a substitute for professional medical diagnosis, treatment, or advice from a qualified healthcare provider.
Similarly, nutrition recommendations and workout plans generated by Ziko AI are intended to support healthy lifestyle choices and are not individualized medical nutrition therapy, physical therapy, or professional fitness instruction. Every individual is different, and recommendations that are appropriate for one person may not be appropriate for another.

5. Acceptable Use
We want Ziko AI to be a safe, respectful, and enjoyable experience for everyone. By using the Services, you agree to use them responsibly and in accordance with these Terms and all applicable laws.
To help us maintain a secure and reliable platform, you agree not to:
- use the Services for any unlawful, fraudulent, or harmful purpose;
- attempt to gain unauthorized access to the Services, our systems, or other users' accounts;
- interfere with, disrupt, or compromise the security, integrity, or performance of the Services;
- reverse engineer, decompile, copy, or attempt to extract the source code, underlying models, or proprietary technology used to operate the Services, except where such restrictions are prohibited by applicable law;
- use automated tools, bots, scripts, or similar methods to access or interact with the Services without our prior written permission;
- attempt to bypass subscriptions, credit limits, security measures, or other technical protections implemented by SAPYENS;
- use the Services in a way that could overload, damage, or negatively affect the experience of other users;
- create false identities or multiple accounts for deceptive or fraudulent purposes;
- share, sell, rent, transfer, or resell your account or your access to the Services;
- upload, submit, or share content that is illegal or that infringes the rights of others; or
- knowingly use the Services in a manner intended to exploit vulnerabilities, manipulate AI-generated responses in ways that could harm others, or otherwise abuse the Services.
We understand that curiosity and experimentation are a natural part of using AI-powered technology. Nothing in these Terms is intended to prevent normal, creative, or legitimate use of the Services. These guidelines simply help us protect the security, reliability, and fairness of the experience for everyone.
If we believe that these guidelines have been intentionally or repeatedly violated, we may take reasonable steps to protect the Services, including limiting or suspending access when necessary.
6. Subscriptions, Billing & Credits
Ziko AI offers both free and paid subscription plans. The features, usage limits, available credits, and pricing associated with each plan are presented within the Services and may be updated from time to time.
Paid subscriptions may be purchased on either a monthly or yearly basis. Monthly subscriptions automatically renew each month, and yearly subscriptions automatically renew each year unless cancelled before the next billing date. You may cancel your subscription at any time through the platform from which you purchased it. Cancellation will prevent future renewals but will not affect access to the remaining subscription period that has already been paid for.
All subscription payments are securely processed by the Google Play Store or the Apple App Store. SAPYENS does not directly process or store your payment information.
Certain features of the Services operate using a credit system. Credits may be included as part of your subscription or otherwise made available through the Services. Unless otherwise stated:
- up to 50 unused credits may roll over into the following billing period;
- rolled-over credits expire two (2) months after they are earned if they remain unused;
- credits are personal to your account and cannot be sold, transferred, exchanged, or assigned to another user; and
- unused credits have no cash value.
Except where required by applicable law or expressly approved by SAPYENS in exceptional circumstances, credits are non-refundable.
Refunds for subscription purchases are governed by the policies of the Google Play Store or Apple App Store, depending on where the purchase was made. Requests for refunds should generally be submitted through the applicable app store.
From time to time, we may introduce new subscription plans, promotional offers, or additional features to improve the Services. Any such changes will apply prospectively and will not affect subscriptions that have already been purchased unless clearly communicated to you.
We believe in offering flexible access to Ziko AI, and we encourage you to choose the subscription plan that best fits your goals and usage.
7. User Content
Certain features of Ziko AI allow you to upload or create content, such as profile information, meal photos, progress photos, notes, workout logs, and other information you choose to provide ("User Content").
You retain ownership of your User Content. Nothing in these Terms transfers ownership of your content to SAPYENS.
By uploading or submitting User Content through the Services, you grant SAPYENS a limited, non-exclusive, worldwide, royalty-free license to store, process, reproduce, transmit, and display that content solely for the purpose of operating, maintaining, securing, improving, and providing the Services to you.
You are responsible for ensuring that you have the necessary rights to upload any User Content and that doing so does not violate applicable laws or the rights of others.
We encourage you to upload only content that is relevant to your use of the Services. You should not upload content that is unlawful, infringes the intellectual property or privacy rights of others, or is otherwise prohibited by these Terms.
SAPYENS does not claim ownership of your User Content, and any rights you grant under these Terms end when your content is permanently deleted from our systems, except where continued retention is required by law, necessary for legitimate legal purposes, or described in our Privacy Policy.
8. Intellectual Property
Ziko AI and all of its components are the intellectual property of SAPYENS or its licensors and are protected by applicable intellectual property laws.
This includes, but is not limited to, the application's software, design, user interface, branding, logos, trademarks, graphics, text, databases, AI systems, algorithms, models, features, functionality, and all related content made available through the Services.
Subject to these Terms, SAPYENS grants you a limited, personal, non-exclusive, non-transferable, and revocable license to access and use the Services for your own personal, non-commercial use.
Except where expressly permitted by applicable law or with our prior written permission, you may not copy, reproduce, distribute, modify, create derivative works from, publicly display, commercially exploit, or otherwise use any part of the Services outside their intended purpose.
Nothing in these Terms transfers ownership of any intellectual property rights belonging to SAPYENS or its licensors. All rights not expressly granted to you remain reserved.
We invest significant care into designing and improving Ziko AI, and these protections help us continue delivering innovative features and a high-quality experience for all users.
9. Service Availability & Updates
Our goal is to provide a reliable, secure, and continuously improving experience. To achieve this, we regularly maintain, update, and enhance Ziko AI.
From time to time, we may introduce new features, improve existing functionality, modify certain aspects of the Services, or discontinue features that are no longer practical or beneficial. Whenever possible, we aim to make these changes in a way that enhances the overall user experience.
Although we strive to keep the Services available at all times, there may occasionally be interruptions due to scheduled maintenance, software updates, technical issues, security measures, or circumstances beyond our reasonable control. We work to minimize any disruption and restore normal service as quickly as reasonably possible.
As technology evolves, certain devices, operating systems, or software versions may eventually become unsupported. We may establish minimum technical requirements to help ensure the security, stability, and performance of the Services.

However, like all software and online services, Ziko AI is provided on an "as is" and "as available" basis. While we make reasonable efforts to provide a dependable service, we cannot guarantee that the Services will always be uninterrupted, error-free, completely secure, or free from technical issues.
We also cannot guarantee that every feature, recommendation, AI-generated response, or piece of information will always be accurate, complete, or suitable for every individual situation.
To the fullest extent permitted by applicable law, SAPYENS disclaims all warranties, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from a course of dealing or usage of trade.
Nothing in these Terms excludes or limits any warranty or legal right that cannot be excluded or limited under applicable law.
11. Limitation of Liability
We genuinely want Ziko AI to be a positive and reliable experience, and we make reasonable efforts to provide accurate information, maintain the security of the Services, and continuously improve the platform.
However, to the fullest extent permitted by applicable law, SAPYENS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, loss of business opportunities, or other indirect losses arising from or relating to your use of, or inability to use, the Services.
SAPYENS is also not responsible for losses or damages resulting from circumstances that are beyond our reasonable control, including internet or network failures, outages of third-party services, cyberattacks, natural disasters, governmental actions, or other events that could not reasonably have been prevented.
You acknowledge that the Services are intended to support your health and fitness journey but do not guarantee any particular health, nutrition, fitness, or personal outcomes. Decisions regarding your health, diet, exercise, or lifestyle remain your responsibility.
Nothing in these Terms limits or excludes liability where such limitation or exclusion is prohibited by applicable law, including liability for fraud, fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.
Our liability protections are intended to create a fair balance between providing innovative digital services and recognizing that certain factors remain outside our control. They do not reduce our commitment to continually improving Ziko AI or to supporting our users with care and transparency.
12. Suspension & Termination
You are free to stop using Ziko AI at any time. You may also delete your account through the options available within the Services, subject to our Privacy Policy and any legal obligations requiring us to retain certain information for a limited period.
If you choose to cancel a paid subscription, your cancellation will take effect at the end of your current billing period. Unless otherwise required by applicable law or the policies of the Google Play Store or Apple App Store, payments already made are non-refundable.
We hope such situations are rare, but SAPYENS may suspend or terminate access to the Services if we reasonably believe that it is necessary to protect the security, integrity, or lawful operation of the Services, to comply with legal obligations, or because these Terms have been materially or repeatedly violated.
Where reasonably possible, we will seek to take fair and proportionate action. Depending on the circumstances, this may include providing a warning, temporarily restricting access, or permanently closing an account. However, we reserve the right to act immediately when doing so is necessary to protect our users, the Services, or our legal obligations.
Termination of your account does not affect any rights or obligations that, by their nature, are intended to continue after termination, including provisions relating to intellectual property, limitation of liability, dispute resolution, and any other applicable legal protections.
13. Changes to these Terms
As Ziko AI continues to evolve, we may occasionally update these Terms to reflect new features, improvements to the Services, changes in applicable laws, or other legitimate business or operational needs.
When we make material changes, we will take reasonable steps to notify users, such as through the Services or by other appropriate means, where required by applicable law. The updated Terms will become effective on the date specified within the revised version.
By continuing to use the Services after updated Terms become effective, you agree to the revised Terms. If you do not agree with the changes, you may stop using the Services and delete your account at any time.

14. Governing Law
These Terms and any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Services shall be governed by and interpreted in accordance with the laws of the Republic of Lebanon, without regard to its conflict of law principles.
Where permitted by applicable law, the courts of the Republic of Lebanon shall have exclusive jurisdiction over any dispute arising from or relating to these Terms or the Services.
Nothing in these Terms limits any mandatory consumer rights or legal protections that apply under the laws of your country of residence where such rights cannot legally be excluded or limited.
